Terms of Service

SlabGeek provides an online marketplace that allows independent buyers and sellers to discover, list, discuss, negotiate, buy, and sell graded collectible cards.

SlabGeek is a marketplace platform. Unless we expressly state otherwise for a particular service, SlabGeek is not the buyer or seller of items listed by users and is not a party to transactions between buyers and sellers.

Under SlabGeek’s current direct-transaction model:

• SlabGeek does not collect or hold the purchase price for cards.
• SlabGeek does not process card payments.
• SlabGeek does not take possession of or ship cards.
• SlabGeek does not physically inspect or authenticate cards.
• Buyers and sellers choose and arrange payment and shipping directly.
• SlabGeek does not guarantee that a transaction will be completed.

A buyer and seller are responsible for determining and agreeing upon the final terms of their transaction, including payment method, shipping, insurance, delivery, returns, and any other transaction-specific terms.

SlabGeek may introduce optional transaction, authentication, payment, shipping, protection, or other services in the future. Additional terms may apply to those services.

Buyers are responsible for reviewing a listing before making an offer or completing a transaction.

This includes reviewing the item description, photographs, PSA certification information, seller information, asking price, and any other available information.

Buyers should independently determine whether an item and its price are appropriate for them.

An accepted offer on SlabGeek indicates that a buyer and seller have agreed on a proposed purchase price. Because payment and fulfillment currently occur outside SlabGeek, an accepted offer does not mean that SlabGeek has received payment, confirmed shipment, authenticated the item, or guaranteed completion of the transaction.

Buyers are responsible for selecting an appropriate payment method and understanding any protections offered by that payment provider.

SlabGeek may display information about payment methods that may offer purchase protection for eligible transactions. Eligibility and protection are determined solely by the applicable payment provider and its terms. SlabGeek does not provide or guarantee third-party payment protection.

By listing an item on SlabGeek, you represent and warrant that:

• you own the item or are authorized to sell it;
• the item is in your possession or control;
• the listing accurately describes the item being offered;
• photographs represented as photographs of the actual slab show the actual item being offered;
• certification information is accurate to the best of your knowledge;
• the item is not counterfeit, stolen, unlawfully obtained, or subject to another person's ownership rights;
• your listing does not violate applicable law or third-party rights; and
• to the best of your knowledge, the card and graded holder are authentic, unaltered, and accurately represented.

You are responsible for setting your asking price and deciding whether to accept, decline, or counter an offer.

Sellers are responsible for safely packaging and shipping items, providing any agreed tracking or insurance, and fulfilling the transaction according to the terms agreed with the buyer.

You may not intentionally misrepresent a card's identity, grade, edition, printing, certification number, condition, provenance, value, or other material characteristic.

SlabGeek may remove or restrict listings that we reasonably believe violate these Terms or create a risk to users or the marketplace.

SlabGeek may require sellers to complete identity verification before publishing listings or accessing certain marketplace features.

Identity verification may be performed by a third-party provider.

An “Identity verified” indicator means that the seller completed the identity-verification process required by SlabGeek. It does not mean that SlabGeek endorses the seller, guarantees the seller's conduct, guarantees a transaction, or authenticates the seller's inventory.

Identity verification cannot eliminate the risk of fraud. Buyers should continue to exercise reasonable care when transacting with another user.

SlabGeek may use PSA certification information to help identify cards, grades, sets, variants, certification numbers, and other characteristics.

When SlabGeek displays “PSA certification matched,” it means that certification information associated with the listing matched information obtained through our available data sources.

It does not mean that SlabGeek physically inspected or authenticated the card or holder.

A certification number alone cannot establish that the physical slab offered by a seller is genuine or that the item being shipped is the same item represented in the listing.

Buyers should review actual seller photographs and other available information before completing a transaction.

PSA is not responsible for and does not operate SlabGeek. References to PSA and other third-party trademarks, certification information, and services are for identification and informational purposes. All trademarks belong to their respective owners.

Users may make, accept, decline, or counter offers through SlabGeek.

Offers may expire according to the timeframe displayed by the Services.

When an offer is accepted, SlabGeek may connect the buyer and seller so they can arrange payment and shipping directly.

Unless SlabGeek expressly provides otherwise, SlabGeek does not collect the agreed purchase price, hold funds in escrow, control shipment, or determine whether either party has fulfilled the transaction.

Buyers and sellers are responsible for keeping records relating to their transaction.

Users may not manipulate offers, create sham transactions, use multiple accounts to artificially influence activity, or otherwise attempt to create misleading marketplace information.

Buyers and sellers currently arrange payment directly with one another.

SlabGeek may identify third-party payment services that users may choose to use. Those services are independent third parties and are governed by their own terms.

SlabGeek is not responsible for:

• payment-provider decisions;
• payment holds or account restrictions;
• chargebacks;
• payment disputes;
• fraud determinations;
• purchase-protection eligibility;
• refunds administered by a payment provider; or
• losses resulting from a user's choice of payment method.

Users should understand the protections and risks associated with a payment method before sending or accepting payment.

SlabGeek currently charges sellers a 0% marketplace fee for standard listings and transactions completed through the current direct-connect marketplace.

A 0% marketplace fee does not mean that a transaction is free of all costs.

Users may incur third-party costs such as payment-processing fees, shipping charges, insurance, taxes, currency-conversion charges, or other expenses.

SlabGeek may introduce paid features or change its fee structure in the future. We will disclose applicable SlabGeek fees before charging them and will provide notice of material changes as required by applicable law.

Unless SlabGeek expressly provides a shipping service for a particular transaction, shipping is arranged directly between the buyer and seller.

Sellers are responsible for packaging items appropriately and shipping them according to the agreement reached with the buyer.

For valuable cards, users should consider tracked and appropriately insured shipping and signature confirmation where appropriate.

SlabGeek does not control shipping carriers and is not responsible for carrier delays, loss, theft, damage, misdelivery, or other shipping problems arising from a direct transaction.

If a buyer chooses to share a shipping address through SlabGeek, that information may be provided to the applicable seller for the purpose of completing the transaction.

Sellers may use shipping information only as reasonably necessary to complete the applicable transaction and may not sell, publish, or use that information for unrelated marketing or other unauthorized purposes.

Buy Now and SlabGeek checkout are currently paused. While paused, every listing, including listings marked "Sold by SlabGeek", works by offer and message: once an offer is accepted, the buyer and seller arrange payment and shipping directly with each other, and SlabGeek does not process the payment. The terms below continue to apply to orders already placed through Buy Now.

Orders sold by SlabGeek (listings marked "Sold by SlabGeek" with Buy Now):

Due to the collectible nature of graded Pokémon cards, SlabGeek does not currently accept returns for a change of mind.

If your order arrives damaged, is materially different from the listing, or never arrives, contact SlabGeek support. We'll investigate the issue and work toward an appropriate resolution, including a refund when warranted.

Your applicable legal rights are unaffected.

Direct transactions with other sellers:

Because buyers and sellers currently transact directly, they are responsible for agreeing upon and resolving cancellations, returns, refunds, shipping claims, and other transaction disputes.

SlabGeek does not currently provide a general money-back guarantee or guarantee refunds for direct transactions.

We may provide communication tools, reporting tools, account restrictions, or other assistance designed to promote marketplace safety. Any assistance SlabGeek provides does not make SlabGeek a party to the underlying transaction or obligate SlabGeek to reimburse either party.

If you believe another user has engaged in fraud, misrepresentation, or other prohibited conduct, you should report the user or listing to SlabGeek.

SlabGeek may provide estimated values, SlabScores, historical sales information, population information, price charts, market statistics, comparisons, and other data.

These features are provided for informational purposes only.

SlabGeek Est. Value is an estimate based on available market information and methodologies that may change over time.

SlabScore is an informational comparison between a listing's asking price and available pricing information.

Neither represents an appraisal, guaranteed market value, guaranteed sale price, or prediction of future value.

Market data may be delayed, incomplete, inaccurate, unavailable, or affected by differences between cards, grades, variants, editions, transaction circumstances, and data sources.

SlabGeek does not guarantee the accuracy or completeness of market information.

Nothing on SlabGeek constitutes financial, investment, tax, or legal advice or a recommendation to buy, sell, or hold a collectible.

Collectibles can increase or decrease substantially in value. You are responsible for your own buying, selling, and pricing decisions.

Users are responsible for understanding and satisfying taxes, reporting requirements, and other legal obligations arising from their activity on SlabGeek.

The tax treatment of a transaction may depend on the parties, jurisdictions, payment method, transaction structure, and applicable law.

SlabGeek may collect, report, withhold, or remit taxes or transaction information when required by law.

Nothing on SlabGeek constitutes tax advice.

You may not use SlabGeek to:

• list counterfeit, stolen, fraudulent, or unlawfully obtained items;
• knowingly provide false certification or listing information;
• impersonate another person;
• misrepresent your identity;
• manipulate marketplace activity, prices, offers, reviews, or transaction history;
• create fraudulent or sham transactions;
• harass, threaten, defraud, or deceive another user;
• misuse another user's personal information;
• distribute malware or interfere with the security or operation of SlabGeek;
• scrape, harvest, or access the Services through unauthorized automated means;
• circumvent access controls, rate limits, security measures, or account restrictions;
• infringe intellectual-property or privacy rights;
• use SlabGeek for unlawful activity; or
• encourage another person to do any of the above.

We may investigate suspected violations and take appropriate action, including removing content or listings, restricting functionality, suspending accounts, preserving relevant information, or cooperating with lawful requests from authorities.

You retain ownership of photographs, descriptions, messages, and other content you submit to SlabGeek (“User Content”).

You grant SlabGeek a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, format, distribute, and otherwise use your User Content as reasonably necessary to operate, improve, promote, and provide the Services.

You represent that you have the rights necessary to submit your User Content and grant this license.

We may remove User Content that violates these Terms or applicable law.

The Services, including SlabGeek's software, branding, designs, interfaces, text, graphics, and original content, are owned by SlabGeek or its licensors and are protected by applicable intellectual-property laws.

Except as expressly permitted by these Terms, you may not copy, modify, distribute, sell, license, reverse engineer, or commercially exploit SlabGeek's proprietary Services or content without permission.

Third-party card artwork, trademarks, certification marks, product names, and other third-party materials remain the property of their respective owners.

SlabGeek may integrate with or link to third-party services, including identity-verification providers, certification databases, payment providers, shipping providers, analytics providers, and other websites or services.

We do not control those third parties and are not responsible for their availability, accuracy, security, practices, products, or services.

Your use of a third-party service may be governed by separate terms and privacy policies.

Unless SlabGeek expressly states otherwise for a particular service:

SlabGeek does not physically authenticate cards, guarantee the authenticity of any card or graded holder, guarantee a seller's representations, guarantee payment, guarantee delivery, or guarantee successful completion of a transaction.

Seller identity verification, PSA certification matching, seller attestations, market information, reporting tools, and other trust features are designed to provide useful information and reduce risk. They cannot eliminate risk.

Users transact with other users at their own discretion and should take reasonable precautions appropriate to the value and circumstances of a transaction.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

SLABGEEK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND SECURITY.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT MARKET DATA WILL BE ACCURATE, OR THAT USERS WILL PERFORM THEIR OBLIGATIONS.

Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SLABGEEK AND ITS MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOSS OF GOODWILL, OR LOSS OF BUSINESS OPPORTUNITY ARISING FROM OR RELATING TO THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SLABGEEK IS NOT LIABLE FOR LOSSES ARISING FROM TRANSACTIONS BETWEEN USERS, INCLUDING FRAUD, COUNTERFEIT ITEMS, PAYMENT DISPUTES, CHARGEBACKS, SHIPPING LOSS OR DAMAGE, MISREPRESENTATION, OR A USER'S FAILURE TO COMPLETE A TRANSACTION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SLABGEEK'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID DIRECTLY TO SLABGEEK DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) $100.

Some jurisdictions do not permit certain limitations of liability, so some limitations may not apply to you.

To the extent permitted by law, you agree to defend, indemnify, and hold harmless SlabGeek and its members, officers, employees, contractors, affiliates, and agents from claims, liabilities, damages, losses, and reasonable costs and expenses arising from or relating to:

• your use of the Services;
• your listings or User Content;
• your transaction with another user;
• your violation of these Terms;
• your violation of applicable law; or
• your infringement or violation of another person's rights.

You may stop using SlabGeek at any time.

We may remove listings or content, restrict functionality, suspend an account, or terminate access where we reasonably determine that doing so is necessary to enforce these Terms, protect users, prevent fraud or abuse, comply with law, or protect SlabGeek.

Termination does not eliminate obligations or liabilities arising before termination.

Sections that by their nature should survive termination will survive.

SlabGeek is an evolving marketplace.

We may add, modify, suspend, or discontinue features of the Services.

This includes changing marketplace functionality, eligibility requirements, supported collectibles, data sources, transaction methods, optional protection programs, and fee structures.

Where required, we will provide notice of material changes.

We may update these Terms from time to time.

When we make material changes, we will update the “Last updated” date and provide additional notice where required by law.

Your continued use of SlabGeek after revised Terms become effective constitutes acceptance of those Terms to the extent permitted by law.

These Terms and disputes arising from them are governed by the laws of the State of California, without regard to its conflict-of-law principles, except where applicable law requires otherwise.

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

Our failure to enforce a provision is not a waiver of our right to enforce it later.

You may not assign these Terms without our consent. SlabGeek may assign these Terms in connection with a merger, acquisition, corporate reorganization, sale of assets, or by operation of law.

These Terms, together with policies expressly incorporated into them, constitute the agreement between you and SlabGeek concerning the Services.
